
A Florida hospital is settling a class action lawsuit for $220,000 over allegations that its website tracking tools improperly shared patient data with third parties.
The proposed agreement resolves claims that the Mount Sinai Medical Center of Florida potentially exposed protected health information when clients used its website and patient portal due to the tracking, analytics and advertising technologies on the site.
Exposed information may have included individually identifiable information, health status and payment for healthcare services.
Says the lawsuit,
“The complaint alleges violations of the Florida Security of Communications Act, Chapter 934.03, Florida Statutes (“FSCA”), invasion of privacy, and unjust enrichment, and seeking to represent all individuals whose electronic communications with Mount Sinai’s website were allegedly intercepted by the tracking technology on the website.”
The hospital denies any wrongdoing but agreed to the deal to end the litigation.
Eligible class members are those who accessed Mount Sinai Medical Center of Florida’s website or patient portal between June 10th, 2021 and September 18th, 2025. The claimants may receive an estimated $20 cash payment on a pro rata basis after submitting a claim form. Claims must be submitted by September 28th.
All class members qualify for one year of free medical data monitoring services.
A judge is set to hold a final approval hearing for the settlement on October 13th.
