Target Class Action Lawsuit Claims Retailer Kept $994,000,000 Tariff Refund From Shoppers

A major retailer is facing claims it hiked prices to cover import tariffs and then kept nearly a billion dollars in government refunds instead of giving that money back to shoppers.

The class action complaint says Target raised prices on goods to offset tariffs imposed starting in February of 2025 under the International Emergency Economic Powers Act, with about half of its merchandise imported and China as the largest source.

After the U.S. Supreme Court ruled the tariffs unlawful on February 20th of 2026, Target received and announced a $994,000,000 refund in August of 2026.

The suit claims the company has not committed to passing any of that money back to customers, unlike FedEx and UPS.

Plaintiffs Lissa Bernardo Lising and Carly Amundson, who bought items such as baby wipes and children’s clothing, filed the case on September 25th of 2026 in U.S. District Court for the District of Minnesota under case number 0:26-cv-04142.

The complaint brings claims for money had and received, unjust enrichment and declaratory relief on behalf of U.S. consumers who bought tariff-surcharged products on or after February 1st of 2025.

June Hoidal of Zimmerman Reed argued the refund should follow the shoppers who paid the higher prices.

“The tariffs were refunded. The prices consumers paid to cover them were not. That money belongs with the people who paid it.”

No settlement has been reached.
